Five Important Reasons Why a Family with Minor Children Needs to Be Familiar with Wholistic Estate Planning

1. To understand what the government has planned for you if you fail to state your wishes in legally valid ways.

2. To nominate guardians to take care of your kids in an emergency and to raise them in your absence. Who would care for your children if you didn't come home one evening and who would manage the money you left for them if the unthinkable were to happen? If you don't decide who, a court will decide for you! Consider 11 criteria with me for choosing the right person.

3. To protect your family to the extent possible if a working parent becomes incapacitated and can no longer bring in income. Are you at risk of losing any financial security you may have built so far? Do you have a plan if you or your spouse/partner were disabled or died prematurely? Could you stay in your house? Maintain your standard of living? Fund your children's college education? Fund your retirement?

4. To appoint a person to make medical and financial decisions for you if you become incapacitated. None of us wants to be another Terry Schiavo, and few of us are aware of the serious repercussions of not having powers of attorney in place for incapacity. Would you want to be kept on life support indefinitely? Would you be able to access key assets if your spouse/domestic partner became incapacitated and you needed money for the care of your loved one and support of your family?

5. To save on high probate costs and become aware of tax issues related to your assets. Why does everyone want to avoid "probate" and "estate taxes"?

Aida del Valle, Esq. is a graduate of Princeton University and the Boalt Hall, University of California at Berkeley School of Law. She practices throughout the Bay Area exclusively in estate planning, including the drafting of wills, trusts, powers of attorney, and other planning documents. As part of her wholistic practice, Aida does counseling on the meaning of "life legacy" and on the creation of legacy statements to pass on your values and stories to loved ones. Her prime interests outside of the law are community-building, reinventing the legal profession to conform to more humanistic standards, and the practice of the arts, yoga and meditation as tools for transformation.
